Netherlands: right to information in criminal proceedings valid from January 2015

The EU directive on the right to information in criminal proceedings will be transformed into Dutch law and invalidated in Jan. 2015. Changes are that each suspect arrested at the police station will be issued with a written notice of his/her rights. This is a folder to set out the suspects’ rights, such as the right to a lawyer and an interpreter if the suspect does not have sufficient command of the Dutch language. Suspects that have not been detained but are being questioned in connection with a criminal offence will be informed of their rights verbally. Persons who have been detained in connection with the execution of a European arrest warrant will also be issued with a notice of their rights.
